The EU's Digital Services Act requires online platforms to protect minors, and Commission guidelines from July 2025 treat age verification as the appropriate safeguard for porn, with self-declaration ruled insufficient. On 26 March 2026 the Commission provisionally found Pornhub, Stripchat, XNXX and XVideos in breach for admitting users with a click-through age declaration, which could lead to fines of up to 6% of global turnover; no final decision has been announced. The Commission is also rolling out a privacy-preserving EU age-verification app and wants every member state to offer one by the end of 2026.

RegulatorEuropean Commission (very large online platforms) and national Digital Services Coordinators
Who it coversAll online platforms accessible in the EU must ensure a high level of privacy, safety and security for minors. The Commission's 2025 guidelines identify age verification as a proportionate and effective measure for adult content. Very large platforms (e.g. Pornhub, XVideos, XNXX) are supervised directly by the Commission; smaller ones by the Digital Services Coordinator of the member state where they are established. Member states may also impose national age-verification measures on providers based in other member states, subject to the e-commerce directive's conditions (CJEU, 16 June 2026).
Accepted ID methodsPrivacy-preserving age verification (EU age-verification app as reference standard); European Digital Identity Wallets (interoperable); Self-declaration, page blurring, content warnings and 'restricted to adults' labels considered ineffective
Data rulesThe EU blueprint confirms only that a user meets an age threshold, without revealing identity or exact age. Each proof is single-use to limit cross-service tracking, and must not be used for profiling. GDPR applies.
EnforcementThe Commission opened formal DSA proceedings against Pornhub, Stripchat, XNXX and XVideos on 27 May 2025 and issued preliminary findings of breach on 26 March 2026. National Digital Services Coordinators are running a coordinated action against smaller non-compliant porn platforms.
PenaltiesFines of up to 6% of total worldwide annual turnover, plus periodic penalty payments.

Coded as in effect because the DSA has applied to all platforms since 17 February 2024 and the Commission treats self-declaration as non-compliant for porn platforms, but the regulation's text names no specific age-verification method and enforcement runs case by case.

Why is Pornhub still available in the EU?

The Commission found in March 2026 that Pornhub, Stripchat, XNXX and XVideos admit EU users by a simple click confirming they are over 18. National rules change this in places: in France Pornhub shows only a safe-for-work version, and in Germany regulators have ordered some ISPs to block it (see national entries).
